Sereno, Morales Should Accept President Duterte’s Challenge to Resign With Him, Ex-SolGen Explains Why

Chief Justice (CJ) Maria Lourdes Sereno and Ombudsman Conchita Carpio-Morales and should accept the challenge of President Rodrigo Duterte to resign with him, according to former Solicitor General Florin Hilbay. That is, if CJ Sereno and Ombudsman Morales still wanted to return to government offices, and don’t want Duterte to become president again.



“G! VP becomes P; CJ can re-apply for CJ; OMB can become SOJ. P who resigns can't return. Arts.VII, IX, XI of the Constitution. Fun game.” Hilbay tweeted on Sunday, October 1, a day after President Duterte dared Sereno and Morales to resign with him. The challenges came after the Ombudsman announced that it will probe the president.

“I now challenge (Ombudsman) Carpio to resign with me at itong si Supreme Court [Chief] Justice, sige nga. I challenge the two, we will go to Congress, in a simple ceremony, we sign the letter of resignation. Sige nga," President Duterte said during the induction of new officers of the Integrated Bar of the Philippines (IBP) in Davao City.

"And when the time comes, if we cannot agree with each other, then let us decide to submit it to the Armed Forces kasi magkagulo tayo. The Armed Forces and the police will decide it for us para hindi magkagulo-gulo itong bayan.” The tough-talking president added, noting that he will not submit himself to the Ombudsman for investigation.



Instead, President Duterte said that he has the authority to investigate the Ombudsman, and will create a a commission to probe the alleged corruption inside the Office of the Ombudsman. Morales is facing impeachment complaint before the House of Representatives, while Sereno is being accused of not declaring millions in her SALN.



Meanwhile, Section 4, Article VII of the 1987 Constitution clearly states that “Voluntary renunciation of the office for any length of time shall not be considered as an interruption in the continuity of the service for the full term for which he was elected.” On the other hand, Sereno can still be SC Chief Justice, while Morales can still be appointed as Justice Secretary.
